Die Europäische Wirtschaftliche Interessenvereinigung hat sich als europäische Alternative für zahlreiche Unternehmen - und nicht nur Unternehmen im enge¬ren Sinn - und ihren Willen zur grenzüberschreitenden Kooperation schon in den ersten Jahren bewährt. Etwa 5000 Mitglieder bei ca. 800 EWIV in Europa seit Mitte 1989 - diese Zahl spricht eine deutliche Sprache.

Die Fragen der rechtlichen Struktur und Qualität waren bald gelöst. Es gibt keine substantiellen Probleme z. B. vor Gerichten, die rechtliche Fragen beinhalten. Die flexible, unbürokratische Gestaltung der EWIV - und die kurze EWG-Ver¬ordnung - haben sich also ausgezahlt. Die steuerliche Behandlung der EWIV hingegen bereitet insoweit manchmal Mühe, als dass die Finanzverwaltung hier auch nicht so genau weiß, wie sie eine EWIV anpacken soll.

Die vorliegende Arbeit, die mit Förderung des EWIV-Dokumentationszentrums bei LIBERTAS - Europäisches Institut GmbH den Weg an die Öffentlichkeit zu gehen wagte, beruht auf einer Diplomarbeit an der Universität Halle; die nach¬stehenden Ausführungen sind ein Ausschnitt daraus. Eine ganze Anzahl von Ar¬tikeln, Büchern usw. wurde in einer ersten Phase geschrieben, also im Zeitraum bis etwa 1990. In dieser Phase wurde mehr oder weniger fiktiv gearbeitet, ohne Erfahrungswerte. Diese Arbeit hier hingegen wurde im zweiten Halbjahr 1994 quasi als Synthese verschiedener Aufsätze und Bücher, aber auch erster prakti¬scher Erfahrungen kompiliert.

Die Autorin und das EWIV-Dokumentationszentrum wären dankbar, wenn sie ihren Text laufend verbessern bzw. ergänzen könnten. In diesem Sinne laden wir alle Leser zur kritischen Mitarbeit und Vorschlägen ein.
