November 1808 stellt eines der bedeutendsten Ergebnisse der Reformbemühungen im Preußen des frühen 19. Jahrhunderts dar. Sie ist Bestandteil des umfassenden Erneuerungswerkes der preußischen Reformer, allen voran des Freiherrn vom und zum Stein.
Oftmals wird die Preußische Städteordnung von 1808 als der Ursprung gemeindlicher Selbstverwaltung in Deutschland bezeichnet. Zutreffend ist zwar, dass dieses Gesetz bedeutende Neuerungen in der preußischen Kommunalverfassung hervorgebracht, insbesondere eine intensivere Beteiligung der Bürgerschaft an der gemeindlichen normiert und die Abhängigkeit der örtlichen Gemeinschaft von der staatlichen Herrschaftsgewalt in beträchtlichen Maße verringert hat.
Zu beachten ist jedoch, dass der Begriff „Selbstverwaltung“, wie er in der Gegenwart verstanden wird, erst fast ein halbes Jahrhundert später, während der Revolution von 1848/49, geschaffen wurde. Den Rechtsgelehrten wie Stein war er dagegen noch unbekannt.
Die Hausarbeit leitet im ersten Teil mit der Biographie des Freiherrn vom und zum Stein ein. Danach erfolgt eine Erklärung und Interpretation der wesentlichen Regelungen der Städteordnung. Im dritten Teil werden die Entstehungsgeschichte und die Hintergründe der Städteordnung untersucht. Die Hausarbeit schließt mit einer Zusammenfassung der untersuchten inhaltlichen Punkte.
