Studienarbeit aus dem Jahr 2012 im Fachbereich Jura - Strafrecht, Note: 1,0 (15 Punkte Jurasystem), Friedrich-Alexander-Universität Erlangen-Nürnberg, Veranstaltung: Proseminar: Aktuelle Rechtsprechung im Straf- und Strafprozessrecht, Sprache: Deutsch, Abstract: „… Freispruch für Polizistenkiller“, so titelte eine große Zeitung am 5.11.2011. Zugrunde liegt ein Fall, der kontroverse Diskussionen ausgelöst hat. Weite Teile der Bevölkerung zeigten sich empört, die juristische Literatur reagierte dagegen durchweg positiv. Der BGH hat am 2.11.2011 ein Mitglied der „Hells Angels“, einer Rockergang, die für gewalttätige Ausschreitungen bekannt ist, vom Vorwurf des Todschlags gem. § 212 I StGB freigesprochen , nachdem dieser einen Polizisten durch seine eigene Haustür erschossen hatte.

Bei diesem Urteil tauchen Fragen auf. Kann es richtig sein, sofort zu schießen, ohne dem Angreifer zu zeigen, wie schwer man bewaffnet ist? Wie ist es zu regeln, wenn man sich einen Angriff auf das eigene Leben nur vorstellt? Darf man sich gegen die Polizei überhaupt wehren? Kann man bei „Schurken“ als Angegriffenen das Notwehrrecht einschränken?

Diese Arbeit beschäftigt sich mit dem Thema Notwehr gegen Polizeieinsätze und Putativnotwehr unter Bezugnahme auf die Probleme der geschilderten Konstellation. Putativnotwehr liegt vor, wenn sich der Täter tatsächliche Umstände vorstellt, die ihn nach § 32 StGB rechtfertigen würden. Anlässlich des als drastisch empfundenen Urteils muss zunächst abgesteckt werden, welche Verteidigung die Notwehr erlaubt. Ziel dieser Arbeit ist es, klarzustellen, wann Notwehr gegen einen Polizeieinsatz möglich ist und welche Folgen ein Fall der Putativnotwehr nach sich zieht. Anschließend wird diskutiert, ob und wann das Notwehrrecht eingeschränkt werden kann - und ob der Freispruch hier wirklich die richtige Entscheidung war.
