Als Einstieg in die Thematik sollen jedoch zunächst einige grundlegende Erläuterungen erfolgen; die die Voraussetzungen der Entstehung, die Entstehung als solche sowie die Bedeutung des Betriebsrates veranschaulichen sollen. [...] Anders als bei kleinen Betrieben, in denen es allein dem Arbeitgeber obliegt, die sozialen, personellen und wirtschaftlichen Entscheidungen zu treffen, sieht das Betriebsverfassungsrecht für solche Betriebe, die eine bestimmte Betriebsgröße überschreiten, eine besondere Betriebsverfassung vor. In dieser besonderen Betriebsverfassung sind Arbeitnehmervertretungen vorgesehen, denen kraft Gesetz in verschiedenen Entscheidungsbereichen Mitwirkungs- und Mitbestimmungsrechte zugeteilt werden. In diesen Bereichen erlischt somit die Befugnis des Arbeitsgebers, Entscheidungen eigenmächtig zu treffen. Er ist nur noch eingeschränkt leitungsbefugt. Diese Bestimmungen finden ihre gesetzliche Regelung im Betriebsverfassungsgesetz von 1972. [...] In § 130 BetrVG ist festgelegt, dass das Betriebsverfassungsgesetz grundsätzlich nicht im öffentlichen Dienst, sondern nur in der Privatwirtschaft Anwendung findet. Für diesen Bereich gilt das Personalvertretungsgesetz bzw. das Bundespersonalvertretungsgesetz. Die Entscheidung, ob das Betriebsverfassungsgesetz oder das Personalvertretungsgesetz anzuwenden ist, richtet sich also ausschließlich nach der Rechtsform eines Unternehmens. [...]
